Определение государственной измены дано в разделе 3 статьи III Конституции США [ Constitution, U.S.]: "Государственной изменой Соединенным Штатам считается только ведение войны против них или присоединение к их врагам и оказание им помощи и содействия" ["Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort"]. И далее: "Ни одно лицо не может быть осуждено за государственную измену иначе как на основании показаний двух свидетелей об одном и том же очевидном деянии, либо собственного признания на открытом заседании суда" ["No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court"]. Именно этими положениями руководствовался Верховный суд [ Supreme Court, U.S.] при оправдании Аарона Бэрра [ Burr, Aaron] в 1807. Всего в истории США рассматривалось около 40 дел по обвинению в государственной измене, но только единожды Верховный суд утвердил такой приговор. Во многих конституциях штатов также содержатся положения о государственной измене, но известны только два случая осуждения за измену судами штатов: Томаса Дорра [ Dorr, Thomas Wilson] и Джона Брауна [ Brown, John] -
